Divorce in Ukraine: preliminary indications in case of problems in the field of family law and pre-divorce crisis in Ukraine.

There are entities and agencies in Ukraine that offer divorce procedures at "very low season" prices:

what is the truth?

«This is an often debated topic, especially after those assisted have enormous problems.

An essential premise: in Ukraine the prices of goods and services have long been equal to those in Europe. Suffice it to say that a coffee in Kyiv also costs 50 hryvnia, the equivalent of 1.50 euros.

In the firm's vast experience, we often find ourselves having to pick up the pieces after the damage caused by similar realities. We even found one company selling a divorce service at prices so low that no one could compete. In truth, we are faced with dubious and dangerous situations. These individuals, not professionally trained, limit themselves to filling out pre-compiled forms which are personally signed by the party and sent by post to the court asking it to proceed in the absence of both the appellant and the respondent. Then, in theory the procedure should go automatically, but in reality it is never like that!

Over the years we have encountered people who thought they were divorced and were not; of practices that had stalled and the non-Ukrainian party, not having a defense in Ukraine, nor an address for notifications, had not been aware of the continuation and even disadvantageous decisions of the Ukrainian court on the divorce.

In truth, very often, initial "flicker prices" are followed by real well-thought-out traps.

We need to take inspiration from a couple of situations that former customers of certain "realities" have experienced, despite themselves.

Let's start from the story of an Italian man, who, certain of having landed the deal of his life, turned to a Ukrainian man at "low cost" prices. This person had been offered a divorce at a price of just over 500 euros. In truth, the “reduced sale” price was for just going to court. Subsequently (but it was not said), in the case of further pleadings the cost was around 300 euros each, for each simple hearing the equivalent (in local currency) of 200 euros and so on. But the final surprise was when this gentleman was told that to withdraw the sentence and register the divorce in the Italian consulate, he would have to intervene personally in Ukraine or pay the equivalent of another 900 euros. In the end, this person spent over 3000 euros for an ordinary divorce, initially believing that he would have spent 500.

But the story that absolutely needs to be disclosed is the following. A young foreigner, not Ukrainian, from a wealthy family, meets a Ukrainian peer during an international university experience. The love at first sight is so blinding that the two, despite the reservations of the boy's family, hastily get married by going to Ukraine.

As it happens, love at first sight quickly fades and, after a short time, the young newlyweds, once the storm of love has passed, understand that they have made a hasty choice.

In order to resolve the issue as quickly and at the lowest possible cost, the boy turns to a company with incredibly affordable prices: a real gift! He was certain that the girl who had already left his life would have nothing against him. The young husband reported that although the advertising of this studio was based on knowing how to speak Italian, in this case, the language was known in a basic and insufficient form to be able to establish an excellent professional relationship.

Divorce turns out to be more conflictual than expected. In fact, the girl, probably well advised, asks for the payment of half the value of a car purchased during the marriage and other assets. The foreigner punctually sends documents and his/her considerations by e-mail to reply to the appointed agency.

After about a year of back and forth, the court issues its sentence. The boy was satisfied and certain that he had closed this sad page in his life. The Ukrainian consultant he turned to guarantees, subject to further donation, that he would register the divorce with the authorities of his country of origin. In fact, after a few months the divorce was registered in Italy. The Italian believes in having escaped the danger.

Incredibly, almost a year after the divorce, the young Italian received a warning from a Roman law firm, which states that if within fifteen days he had not paid the ex the sum of almost twenty-one thousand euros, they would proceed with the actions of recognition of the judgment in Italy at the competent court of appeal, with further disbursements.

In simple words, with the divorce decree and the further actions taken, the ex-wife had obtained reimbursement of fifty percent of what had entered into the family during the marriage (primarily the car) and the sentence had not been challenged on appeal. Obviously, the young Italian was unaware of the whole thing.

This firm learned of this sad story following the assignment for the appeal for review of the divorce sentence in Ukraine.

Let the reader judge."

I would absolutely like to try to reconcile with my Ukrainian wife: what to do?

«Trying to reconcile with your Ukrainian wife is right, but with due caution. In fact, if necessary, this firm always attempts a conciliation, but in a professional manner and without exposing the client to risks.

Many people who contact this International Law Firm for Ukraine, before meeting us, have already made gross and often serious mistakes in the vain and illusory attempt to reach a reconciliation with the Ukrainian partner.

The methods often used by non-Ukrainian foreigners to try to win back their Ukrainian partner is to go to Ukraine and indulge in various, expensive gifts and economic benefits. Some go so far as to sign documents before Ukrainian notaries, of which they were unaware of the content and above all the legal value, in order to demonstrate their great attachment and desire to start again. It is clear that in the last case, when the ex proposes the signing of deeds and documents with various excuses, for example, stating that he does not feel safe about the future, in most cases, while pretending to have a reconciliatory intention, he has has the clear idea of putting an end to it and preserving the advantages that it would otherwise not have in non-Ukrainian foreign states as well as in Ukraine. Unfortunately, this is a fairly common behavior that non-Ukrainian foreigners in Ukraine suffer due to divorce issues.

In the vast majority of cases, attempts at reconciliation are completely useless, they prolong the suffering and induce the other party to strengthen their intentions, because they feel legitimised, since they perceive that they are dealing with an undecided, fearful, weak and therefore manageable subject".

What is the average user who encounters conflictual divorce cases in Ukraine?

«The typical client is often an honest worker, sometimes retired, on average well-off and understandably anxious about what is happening to him with his Ukrainian wife. The apprehension is justified, since for some it is based on the presence of children, sometimes held against the father's will in Ukraine. On the point of international child abduction, the appropriate page is recommended».

How long does a mixed marriage with a Ukrainian wife last on average?

«More than talking about duration in itself, it is appropriate to divide marriages and divorces in Ukraine into two macro categories. Marriages lasting more than five years which usually tend to last, obviously there are exceptions and conversely divorces in so-called "flash" marriages with Ukrainian women. Brief acquaintance, quick marriage and divorce. Generally, divorce in the absence of children is requested by one of the two parties even after a few months. In the presence of children conceived in the period close to the celebration of marriage with a Ukrainian woman, the period of married life is longer for logistical and legal reasons."

What are the main causes of divorce with Ukrainian women?

«In many cases the rush leads to marriages being celebrated that are completely unlikely and have a predictable outcome due to excessive differences in age, culture and perspectives. It should be noted that in Ukraine the excessive age difference between spouses is unusual. On this point, it is essential to understand the false legend that goes around in Ukraine, where, for example, Italy is said to be a place where people live in "Arabian Nights" places like Capri, Ischia or Procida and earn a lot . This triggers the temptation for Ukrainian women to marry an Italian at any cost. In the belief of many Ukrainian women there are incorrect parameters regarding the very comfortable life that one will find in Italy. They believe that they will manage an Italian salary with the cost of living as in the Ukrainian province. Finally, when these Ukrainian women immediately understand that the average Italian cannot afford Ferrari, Prada, Gucci etc. every day. etc., if they are linked to their husband only from an economic point of view, they plan to return hastily to their homeland, plundering what they can, hoping to make a richer life in Ukraine by supporting their ex.

Sorry to say, but in many cases the divorce has been planned since the beginning of the relationship. Often it is not a feeling that leads to marriage, but the aim of living in total economic comfort."

What is the main mistake of theof non-Ukrainian foreigners What is found in divorces in Ukraine?

«Very often, because the non-Ukrainian foreigner is driven by a true feeling, he does not accept that the ex is no longer a faithful wife, but is in fact a real enemy. The ex's only goal is to make the most of the affair. It doesn't matter that the one who until the day before was a loving husband is now suffering tremendously and doesn't understand why the story he had invested so much in is over.  A common point among many clients, faced with the crisis of marriage with a Ukrainian, is that of having wasted precious time improvising, taking information on social media Facebook above all and in unsuitable consultancy. Consultants who ignore Ukrainian legislation and vice versa or, even, in some cases, the clients had turned to unspecified "Ukraine experts", seriously compromising the results. They are often activated by inexperienced in Ukrainian law, judicial procedures, for example outside Ukraine, when the problem is primarily in Ukraine, or in the face of a Ukrainian decision, now matured, one doesn't have the faintest idea of how to counter it both in Ukraine and outside Ukraine, since one doesn't have the concepts of Ukrainian or international law and integrated with Ukrainian law.

Indeed, as a law firm in Ukraine, we have found cases in which non-Ukrainian foreigners, trusting them, went to a court in Ukraine without protection (!) or with a lawyer appointed by their ex (!!), to accept consensual divorces with halter conditions!!! Obviously, once these people came to their senses, they were forced to ask for a review of the judgement, imposing double, difficult work on us and consequently exposing themselves to greater risks and expenses."

Which professional carries out the profession with Ukraine, not occasionally, but predominantly. On this point we recommend the page on integrated legal assistance  in Ukraine».

They offered me to carry out the divorce proceedings before the zags in the city of Ukraine where I got married:

I can do it?

"The answer is no!

As regards the aforementioned form of divorce in Ukraine, before the zags (civil registry office of the municipality in Ukraine), the question of the validity outside Ukraine of said form of divorce in Ukraine is exposed to numerous complaints with rejections in the process of transcription and recognition outside Ukraine. In fact, it is not unusual for this firm, being qualified to practice law also outside Ukraine and authorized to practice in Ukraine, to have been instructed to intervene before the authorities outside Ukraine who refused the registration of this form of divorce in Ukraine .

The risk is that of being divorced, but at the same time remaining tied to an already dissolved marriage, for any future fulfillment outside Ukraine, such as contracting a new marriage or purchasing goods, etc. etc.

The legal reasons that lead to what has just been stated are explained on the appropriate page».
