Legislation for the establishment, training and officialization of national and international chambers of commerce in Ukraine.
The Ukrainian Chamber of Commerce and Industry is a non-governmental, non-profit and autonomous organization. Entities contributing to establishing a Ukrainian CCI must be registered as entrepreneurs.
An essential premise is to represent that in Ukraine by law only one chamber of commerce and industry is allowed per region which takes its name from the name of the same region. No exceptions of any kind are permitted, such as branch offices outside Ukraine, nor are there any special companies as in Italy. The region (oblast) bears the name of the capital city as well as the CCIU. So, for example, the chamber of commerce and industry of the Poltava region bears the name of its capital city, namely Poltava and so on. An exemption is established by law for the city of Kyiv alone, which enjoys equal status to the oblasts (regions). Therefore Kyiv has its own chamber of commerce and the Kyiv region a separate one from the former. The minimum number of exclusively Ukrainian founding entrepreneurial members of a CCIU cannot be less than 50 and must appear in the articles of association. Private associations, companies and the like are not entitled to bear the name Chamber of Commerce and Industry of Ukraine or Chamber of Commerce of Ukraine, in short CCIU or CCU.
What has just been expressed is mandatorily established by the above-mentioned law 52 of 1998, which regulates the chambers of commerce in Ukraine. Furthermore, in Ukraine there is a chamber for international commerce for foreign trade only (Ukrainian export, no import) of state origin, with headquarters in Kyiv. In Ukraine, unlike Italy, no mixed chambers have been launched, nor foreign or Ukrainian chambers of commerce abroad. In theory, mixed foreign chambers would be possible, for example the Alpha State or Beta/Ukraine, on the sole condition, by law, that at least half of them plus a regional CCIU are consortiums. An agreement attempted in the past, but failed.
There are 25 chambers of commerce and industry in Ukraine and they can appoint delegates for relations, including with foreign countries, natural persons. The delegates, to demonstrate their status must be nominated on the official website of the chamber to which they belong.
The Ukrainian chambers of commerce and industries are: Vinnytsia CCI, Volyn CCI, Dnipropetrovsk CCI, Donestk CCI, Zhytomyr CCI, Zaporizhia CCI, Zakarpattya CCI, Ivano-Frankivsk CCI, Kyiv CCI, Kyiv Region CCI, Kirovohrad CCI, Luhansk CCI, Lviv CCI , Mykolaiv CCI, Odessa CCI, Poltava CCI, Rivne CCI, Sumy CCI, Ternopil CCI, Kharkiv CCI, Kherson CCI, Khmelnytskyi CCI, Cherkassy CCI, Chernivtsi CCI, Chernihiv CCI.
These CCIUs, in addition to the local headquarters in the regional capital, also have a representative office in Kyiv in Zhytomyrska str. n° 33. In this Capitoline address, all the Ukrainian CCIs are gathered as the national representative office called UCI "Union of Chambers of Commerce and Industry". The central UCI and 25 regional CCIs including that of the capital city are the structure of chambers of commerce and industry.
Today the Chamber system brings together over 8 thousand members. Over 1000 company representatives from all parts of the country receive daily professional advice and are helped by experts from chambers of commerce and industry in different directions. The UCI has representatives in 23 countries, has signed 91 international cooperation agreements with foreign partnership organizations. The UCI is the founder and coordinator of 34 bilateral works councils. 85% of the members of the Chambers are small and medium-sized enterprises, 15% - large companies, including JSC «Ukrnafta», JSC «Zaporizhstal», «Metinvest Holding» Ltd., JSC «Turboatom», JSC «Motor-Sich », SE «Antonov» and others. Among the member companies of the Chamber - more than 60 business associations of the country: the Ukrainian Association for Quality, the Ukrainian Association of Light Industry Enterprises «Ukrlegprom», the Association of Turkish Enterprises in Ukraine TUID. UCI is a member of the International Chamber of Commerce of the World Chambers Federation and Eurochambres.
Any different type of entity not illustrated above does not fall within the category of CCIU (Ukrainian chambers of commerce and industry).
To summarize, the official Chambers of Commerce and Industry of Ukraine have the following requirements and are formed as follows:
1) arise following Ukrainian law 52 of 1998;
2) at the time of its establishment, no fewer than 50 Ukrainian business members had to participate and sign;
3) there are 25, and one chamber of commerce and industry is permitted in Ukraine per region (oblast) with the sole exception of the cities of Kyiv. To date, all oblasts have a CCIU;
4) the official chambers of commerce and industry of Ukraine have, in addition to the local headquarters, a permanent representative office in Kyiv at the National Headquarters in Zhytomyrska str. n° 33.
